Over the last decade, several European countries and the Council of Europe itself have strongly supported the use of advance directives as a means of protecting patients’ autonomy, and adopted specific norms to regulate this matter. However, it remains unclear under which conditions those regulations should apply to people who are placed in correctional settings. The issue is becoming more significant due to the increasing numbers of inmates of old age or at risk of suffering from mental disorders, all of (...) whom might benefit from using advance directives. At the same time, the closed nature of prisons and the disparate power relationships that characterise them mean that great caution must be exercised to prevent care being withdrawn or withheld from inmates who actually want to receive it. This paper explores the issue of prisoners’ advance directives in the European context, starting with the position enshrined in international and European law that prisoners retain all their human rights, except the right to liberty, and are therefore entitled to self-determination regarding health care decisions. A curious and comparatively neglected element of death penalty jurisprudence in America is my target in this paper. That element concerns the circumstances under which severely mentally disabled persons, incarcerated on death row, may have their sentences carried out. Those circumstances are expressed in a part of the law which turns out to be indefensible. This legal doctrine—competence-for-execution —holds that a condemned, death-row inmate may not be killed if, at the time of his scheduled execution, he lacks an awareness of (...) his impending death or the reasons for it. I argue that the law of CFE should be abandoned, along with the notion that it is permissible to kill the deeply disturbed just so long as they meet some narrow test of readiness to die. By adopting CFE, the courts have been forced to give independent conceptual and moral significance to a standard for competence that simply cannot bear the weight placed upon it. To be executable, CFE requires that a condemned prisoner meet a standard demonstrating an awareness of certain facts about his death. Yet this standard both leads to confusing and counter-intuitive results and is unsupported either by the reasons advanced by the courts on its behalf or by any of the standard theoretical justifications of criminal punishment. If executing the profoundly psychotic or delusional is wrong the law needs a better account of the wrong done when prisoners like Ford are killed. I suggest wherein that wrong might be located. This paper reconsiders the event in International Relations (IR) through the writings of Hannah Arendt. The event has for too long been neglected in IR; international events are overwhelmingly conceived as mere happenings that have meaning only within the process and temporal structure of the theory from which they are understood, and as holding no or only limited meaning in and of themselves. In her work on political theory and her reflections on totalitarianism, however, Arendt elaborates a rich view of (...) the event and its relationship to history, one that offers an alternative way of thinking about international relations. Arendt urges us to remain open to the possibility, however difficult, of conceiving of the event as meaningful outside of the processes within which our established mode of thoughts would have us subsume it. This requires on the part of the historian a commitment to judgement, to a recognition of the importance of imagination and impartiality that gives meaning to the event for others. In explicating Arendt's complex notion of the genuine political event, the paper aims not merely to demonstrate the intrinsic interest of this conception of the event to her thought, but to add to the small but growing number of works in IR that have found fruitful new avenues of thought in Arendt's various writings, and also to recent discussions on the proper relationship between history and IR theory. Stoffregen & Bardy's proposal that perceptual systems can use information defined across two or more sensory domains is valuable and urgent in its own right. However, their claim of exclusive validity for global-array information is superfluous and perpetuated for incorrect reasons. The seeming ambiguities of individual arrays emanate from failures to consider relevant ecological constraints and higher-order variables.

There is a difference between the private and social cost of preserving the past. While it may be privately rational to forget the past, the social cost is significant: we fail to see that Classical political economy is a polemic against racism. The past is a rich source of surprises and debates, and resources on the Web are uniquely suited to teaching such wide-ranging debates. Students who read Smith juxtaposed with Whitman, who read the Carlyle-Mill exchange, and who see these images, understand the debate the way a student who reads only the Wealth of Nations, Ricardo's Principles, or John Stuart Mill cannot. Over the past two decades, academic economics has undergone a mild revolution in methodology. The language, concepts and techniques of noncooperative game theory have become central to the discipline. This book provides the reader with some basic concepts from noncooperative theory, and then goes on to explore the strengths, weaknesses, and future of the theory as a tool of economic modelling and analysis. The central theses are that noncooperative game theory has been a remarkably popular tool in economics over the (...) past decade because it allows analysts to capture essential features of dynamic competition and competition where some parties have proprietary information. The theory is weakest in providing a sense of when it - and equilibrium analysis in particular - can be applied and what to do when equilibrium analysis is inappropriate. Many of these weaknesses can be addressed by the consideration of individuals who are boundedly rational and learn imperfectly from the past. Written in a non-technical style and working by analogy, the book, first given as part of the Clarendon Lectures in Economics, is readily accessible to a broad audience and will be of interest to economists and students alike. Knowledge of game theory is not required as the concepts are developed as the book progresses. (shrink)

In Emerson and the Conduct of Life, David M. Robinson describes Ralph Waldo Emerson's evolution from mystic to pragmatist, stressing the importance of Emerson's undervalued later writing. Emerson's reputation has rested on the addresses and essays of the 1830s and 1840s, in which he propounded a version of transcendental idealism, and memorably portrayed moments of mystical insight. But Emerson's later writings suggest an increasing concern over the elusiveness of mysticism, and an increasing stress on ethical choice and practical power. (...) I am intrigued by the use of the words ‘embedded’ and ‘capacity’ as they appear in what I take to be the strategy of Sovereignty Across Generations where these words are used to make what is evidently implicit within John Rawls’s political liberalism explicit, that is, a normative account of ‘the justice and legitimacy of political orders’. If I am correct about this strategy, my question is quite simple: is something lost in translation in this transition from Rawls’s more historical (...) to this normative orientation? I conclude with a positive comment on the potential that a theory of temporality has for the development of a notion of political self-constitution as it pertains to the transition from ethnos to demos. The conscious experience of the reading, together with the accompanying background feel of sensation, emotion, and thought, make up how things subjectively seem to you, how things appear, as best you can tell, from your own unique point of view. Consciousness is at once acutely familiar-it makes up the experienced moments of your waking (and perhaps your dreaming) (...) life. But consciousness also raises deep and interesting philosophical questions, questions about how any mere physical subject could produce such a wonder, and questions about how there could be a seemingly private and isolated spot of personal subjectivity in an objective, impersonal world. Perhaps the challenge of developing a satisfying theoretical understanding of consciousness is beyond us-we've reached the limits of what we can comprehend. Or maybe today's shortcomings are only temporary barriers to an illuminating theory of consciousness, one properly embedding it in our scientific worldview. And possibly we already have the resources for a satisfactory theory from the way we think about things in commonsense terms. This reader provides an entry point for considering these and related theoretical questions surrounding consciousness. This introductory section begins with a brief background survey of contemporary debates on consciousness. Xenophon's Socratic Works demonstrates that Xenophon, a student of Socrates, military man, and man of letters, is an indispensable source for our understanding of the life and philosophy of Socrates. David M. Johnson restores Xenophon's most ambitious Socratic work, the Memorabilia, to its original literary context, enabling readers to experience it as Xenophon's original audience would have, rather than as a pale imitation of Platonic dialogue. He shows that the Memorabilia, together with Xenophon's Apology, provides us with our best (...) evidence for the trial of Socrates, and a comprehensive and convincing refutation of the historical charges against Socrates. Johnson's account of Socrates' moral psychology shows how Xenophon's emphasis on control of the passions can be reconciled with the intellectualism normally attributed to Socrates. Chapters on Xenophon's Symposium and Oeconomicus reveal how Xenophon used all the literary tools of Socratic dialogue to defend Socratic sexual morality and debate the merits and limits of conventional elite values. A growing number of technologies are currently being developed to improve and distribute thinking and decision-making. Rapid progress in brain-to-brain interfacing and swarming technologies promises to transform how we think about collective and collaborative cognitive tasks across domains, ranging from research to entertainment, and from therapeutics to military applications. As these tools continue to improve, we are prompted to monitor how they may affect our society on a broader level, but also how they may reshape our fundamental understanding of agency, (...) responsibility, and other key concepts of our moral landscape.In this paper we take a closer look at this class of technologies – Technologies for Collective Minds – to see not only how their implementation may react with commonly held moral values, but also how they challenge our underlying concepts of what constitutes collective or individual agency. We argue that prominent contemporary frameworks for understanding collective agency and responsibility are insufficient in terms of accurately describing the relationships enabled by Technologies for Collective Minds, and that they therefore risk obstructing ethical analysis of the implementation of these technologies in society. We propose a more multidimensional approach to better understand this set of technologies, and to facilitate future research on the ethics of Technologies for Collective Minds. (shrink)

An intermediate stage in Hrushovski’s construction of flat strongly minimal structures in a relational language L produces ω-stable structures of rank ω. We analyze the pregeometries given by forking on the regular type of rank ω in these structures. We show that varying L can affect the isomorphism type of the pregeometry, but not its finite subpregeometries. A sequel will compare these to the pregeometries of the strongly minimal structures.

The deliberative model of politics has recently been criticized for not being very well equipped to conceptualize current developments such as the misinterpretation of political difference, the digital turn, and public protests. A first critique is that this model assumes a conception of public spheres that is too idealistic. A second objection is that it misconceives the relationship between empirical reality and normativity. Third, it is assumed that deliberative democracy offers an antiquated notion of a shared ‘we’ of political actors (...) and because of this, fourth, fails to take into consideration the ‘digital turn’, in particular the de-personalizing effects of social media that have led to a rapid decline of the public sphere. And a fifth critique states that the deliberative model ignores the fact that politics is not, and especially protests and revolutions are not, seminar-like debates but spontaneous, chaotic and sometimes violent expressions. I will argue that all of these critiques fall short in a variety of ways. A deliberative model of politics allows us to address the tension between the ideal and the real, the ‘old media’ and the so-called digitalization of public spheres as well as peaceful discourse and violent uprisings. Especially the concept of communicative power, a notion also used by Hannah Arendt and Jürgen Habermas, reveals the potentials for future participation in digital spaces and public places. (shrink)

Food is a challenging subject. There is little consensus about how and what we should produce and consume. It is not even clear what food is or whether people have similar experiences of it. On one hand, food is recognized as a basic need, if not a basic right. On the other hand, it is hard to generalize about it given the wide range of practices and cuisines, and the even wider range of tastes. This book is an introduction to (...) the philosophical dimensions of food. David M. Kaplan examines the nature and meaning of food, how we experience it, the social role it plays, its moral and political dimensions, and how we judge it to be delicious or awful. He shows how the different branches of philosophy contribute to a broader understanding of food: what food is (metaphysics), how we experience food (epistemology), what taste in food is (aesthetics), how we should make and eat food (ethics), how governments should regulate food (political philosophy), and why food matters to us (existentialism). The first book-length treatment of Paul Ricoeur's conception of philosophy as critical theory.

In this article I take up a central question posed by the article jointly authored with Bill Winslade in this issue of JCE: What should be the role of clinical ethics consultants (CECs) in (what we call) an unsettled case: that is, a situation in which the range of allowable choices, among which the parties to a bioethical disagreement must select, cannot be clearly or completely specified? I argue here that CECs should, in such cases, guide the parties by presenting (...) their own reasoned conclusions about what the scope of allowable choices should be taken to include. Since this position challenges the received view that CECs must not express their own moral positions or conclusions in their role as ethicists, I try to defend my view of the CEC’s role in unsettled cases against several objections. Several bioethical topics received a great deal of news coverage here in Scotland in 2009. Three important issues with transatlantic connections are the swine flu outbreak, which was handled very differently in Scotland, England and America; the US debate over healthcare reform, which drew the British NHS into the controversy; and the release to Libya of the Lockerbie bomber, which at first glance might not seem particularly bioethical, but which actually hinged on the very public discussion of the prisoner’s medical (...) records. On a national level, there have been attempts in both Scotland and England to change the law on assisted suicide, where success looks more likely than ever. This paper will discuss each of these issues, and hopefully raise awareness of how these issues were dealt with in the UK and its component countries. (shrink)

In this thought-provoking book, David Hart challenges the creation myth of post--World War II federal science and technology policy. According to this myth, the postwar policy sprang full-blown from the mind of Vannevar Bush in the form of Science, the Endless Frontier. Hart puts Bush's efforts in a larger historical and political context, demonstrating in the process that Bush was but one of many contributors to this complex policy and not necessarily the most successful one. Herbert Hoover, Karl Compton, (...) Thurman Arnold, Henry Wallace, Robert Taft, and Curtis LeMay--along with more familiar figures like Bush--are among those whose endeavors he traces.Hart places these policy entrepreneurs in the broad scheme of American political development, connecting each one's vision of the state in this apparently esoteric policy area to the central issues, events, and figures of mid-century America and to key theoretical debates. Hart's work reveals the wide range of ideas, often in conflict with one another, that underlay what later observers interpreted as a "postwar consensus." In Hart's view, these visions--and the interests and institutions that shape their translation into public policy--form the enduring basis of American politics in this important area. Although prediction is one of the key tasks of intelligent brains, it often proves impossible in an unpredictably changing world. Hence, brains often decide what happened retrospectively. This framework of postdiction, the opposite of prediction, stands as an alternative or complimentary framework to prediction. I further show how motor-sensory recalibration demonstrates delay compensation at the perceptual level.

We are concerned with the following problem. Suppose Γ and Σ are closed permutation groups on infinite sets C and W and ρ: Γ → Σ is a non-split, continuous epimorphism with finite kernel. Describe the possibilities for ρ. Here, we consider the case where ρ arises from a finite cover π: C → W. We give reasonably general conditions on the permutation structure W;Σ which allow us to prove that these covers arise in two possible ways.
